1. Acceptance of Terms
By accessing and using glowmas Hosting services, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use our services.
2. Service Description
glowmas Hosting provides web hosting, VPS hosting, and dedicated server services. We reserve the right to:
- Modify or discontinue services with reasonable notice
- Refuse service to anyone for any legitimate reason
- Update these terms at any time with notification to customers
- Perform scheduled maintenance with advance notice
3. Account Responsibilities
You are responsible for:
- Maintaining the security of your account credentials
- All activities that occur under your account
- Ensuring content complies with all applicable laws
- Maintaining accurate contact and billing information
- Notifying us immediately of any unauthorized access
4. Acceptable Use Policy
You may not use our services to:
- Send spam or unsolicited bulk emails
- Host malicious software, viruses, or illegal content
- Violate intellectual property rights
- Engage in any illegal activities
- Abuse server resources or network bandwidth
- Harass, threaten, or harm others
- Attempt to gain unauthorized access to systems
5. Email Sending Policy
All emails sent through our infrastructure must comply with the following:
- Be transactional or relationship-based communications only
- Include proper unsubscribe mechanisms as required by law
- Comply with CAN-SPAM Act, GDPR, and other applicable regulations
- Only be sent to recipients who have explicitly opted in
- Not contain misleading subject lines or false header information
- Include your valid physical postal address
We send transactional emails to our customers including: account notifications, password resets, billing confirmations, server alerts, support responses, and system maintenance notices.
6. Payment Terms
Services are billed in advance on a monthly or annual basis. Payment is due upon receipt of invoice. Failure to pay may result in service suspension or termination. Refunds are provided according to our 30-day money-back guarantee for initial purchases only.
7. Service Level Agreement (SLA)
We guarantee 99.9% uptime for our hosting services. This excludes scheduled maintenance, which will be announced at least 24 hours in advance. If we fail to meet our SLA, you may be eligible for service credits calculated as follows:
- 99.0% - 99.9% uptime: 5% credit
- 95.0% - 98.9% uptime: 10% credit
- Below 95.0% uptime: 25% credit
8. Data Backup and Security
While we perform regular backups, you are responsible for maintaining your own backups. We are not liable for any data loss. We implement industry-standard security measures but cannot guarantee absolute security.
9. Termination
Either party may terminate service with 30 days written notice. We reserve the right to immediately suspend or terminate accounts that violate these terms or engage in abusive behavior.
10. Limitation of Liability
Our liability is limited to the amount paid for services in the preceding 12 months. We are not liable for indirect, incidental, or consequential damages.
